1. Introduction
1.1 Welcome to WeWake! WeWake (the “Platform”) is an online service offering astrology consultations, spiritual content, Pooja services, webinars, courses, and related offerings to help users navigate life’s challenges with ancient wisdom. These Terms and Conditions (“Terms”) govern your access to and use of the WeWake website (www.wewake.site), our mobile application “WeWake”, and all services and features provided through them (collectively, the “Services”).
1.2 The Platform is owned and operated by Spiritual Sutra Private Limited, an Indian company registered under the Companies Act, 2013, with its registered office at 264/265, Vaswani Chambers, Dr. Annie Besant Road, Worli, Mumbai – 400030, Maharashtra, India (hereinafter referred to as “WeWake”, “the Company”, “we”, or “us”). By using our Services, you (the user) agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Platform or any Services. We recommend that you read these Terms carefully and print or save a copy for your records.
1.3 Your acceptance may be evidenced by electronic means, which shall have the same legal effect as a physical signature under the Information Technology Act, 2000.
1.4 These Terms apply to the website, any future mobile applications, physical or digital products sold directly or through third-party affiliates, and all services provided under the WeWake brand.
2. Definitions
2.1 For the purposes of these Terms, the following terms shall have the meaningsascribed below:
2.1.1 Practitioner: Includes astrologers, Vastu consultants, Poojari’s, priests, service providers, or any experts offering Services on the Platform, used interchangeably.
2.1.2 Services: The range of offerings provided by WeWake, including but not limited to astrology consultations, Pooja and spiritual services, product sales, courses, webinars, content and tools, mobile application features, subscription plans, and affiliate/referral programs, as further detailed in Section 3.
2.1.3 Platform: The WeWake website (www.wewake.site), mobile application, and any related digital interfaces or features.
2.1.4 User/You: Any individual or entity accessing or using the Services or Platform.
2.1.5 Personal Data: As defined under the Digital Personal Data Protection Act,2023, any data about an individual who is identifiable by or in relation to such data.
2.1.6 Child/Minor: Any individual under the age of 18 years.
2.1.7 Data Fiduciary: WeWake, in its role under the Digital Personal Data Protection Act, 2023, responsible for determining the purpose and means of processin Personal Data.
2.1.8 Site Content: All text, graphics, logos, images, audio clips, videos, software,and compilations thereof available on the Platform.
2.1.9 Paid Services: Any Services requiring payment, such as consultations, Pooja services, courses, or product purchases.
3. Scope of Services
3.1 WeWake provides a range of Services to users. Our current and potential future offerings include, but are not limited to:
3.1.1 Astrology Consultations: Personalized Vedic astrology consultations (e.g., Kundali readings, Prashna Kundali sessions) covering career, marriage, health, finances, relationships, and other life areas. Consultations may be delivered via chat, phone, video call, or in written report format by experienced astrologers.
3.1.2 Pooja and Spiritual Services: Facilitation of Poojas (prayer ceremonies) and other spiritual or religious rituals on behalf of users, performed by qualified Practitioners. WeWake acts solely as a facilitator for Pooja services and does not perform rituals itself; any outcomes are subject to the Practitioner's discretion. We may also offer ritual products or prasad delivery associated with these services.
3.1.3 Product Sales: Sale of spiritual and astrological products, including but not limited to gemstones, yantras, malas, Rudraksha, Jadi (tree roots), and other remedies recommended during consultations or for personal use. These may be offered independently or in conjunction with other Services, with delivery options available.
3.1.4 Courses and Webinars: Educational webinars, workshops, and courses on astrology, spirituality, Sanatana Dharma, and related topics to help users deepen their knowledge and personal growth.
3.1.5 Content and Tools: Informational content such as articles, blogs, horoscopes, spiritual guides, calculators (e.g., Kundali or compatibility calculators), and other resources provided for personal insight and learning.
3.1.6 Mobile Application: A mobile app that allows convenient access to our services, booking consultations, receiving updates, etc. (when launched). The same Terms apply to usage of the app.
3.1.7 Subscription Plans: In the future, we may introduce membership or subscription plans (for example, monthly packages or premium content subscriptions) that provide additional benefits or unlimited services for a recurring fee. Such plans will be subject to these general Terms and any specific terms we communicate at the time of offering.
3.1.8 Affiliate/Referral Program: We may also introduce affiliate or referral programs enabling users or third parties to earn rewards or commissions for referring new users to WeWake. Participation in any affiliate program will be governed by these Terms and any additional guidelines we publish.
3.2 WeWake continually innovates and improves its offerings. Any new feature, service, or product introduced by WeWake will, unless stated otherwise, be considered part of the “Services” and will be covered by these Terms. We reserve the right to modify, expand, or discontinue any Service (or any part or feature of a Service) at our discretion, with or without notice, as described in the “Changes to Terms and Services” section below.
3.3 WeWake acts solely as a facilitator for Pooja services and rituals performed by independent Practitioners. We do not perform such rituals ourselves, and outcomes are at the sole discretion of the Practitioner. We expressly disclaim liability for third-party products, rituals, or services offered through or linked from our Platform.
4. Acceptance of Terms
4.1 By accessing or using the Platform and Services, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy (available
on our website). You may be required to actively confirm your acceptance (for example, by clicking “I Agree”) when creating an account or making a booking. Even if not explicitly asked, your continued use of any Service signifies your acceptance of these Terms. If you do not agree with these Terms at any time, you must stop using WeWake’s Services immediately.
4.2 These Terms form a legally binding agreement between you and WeWake.You represent that you have the legal capacity to accept these Terms. If you are accepting on behalf of a company or other entity, you affirm that you have authority to bind that entity to these Terms.
5. Eligibility
5.1 You must be at least 18 years old and capable of entering into a binding contract under applicable law to use WeWake’s Services. WeWake is intended for adults; accounts for persons under 18 are not permitted.
5.2 Minors (Under 18): If you are under 18 and still wish to use certain Services (for example, to ask a question about a minor’s horoscope or to participate in a family Pooja), a parent or legal guardian must register on the Platform and supervise all interactions. The parent/guardian will be responsible for all use of the Services by the minor. WeWake does not knowingly collect personal information from anyone under 18 without parental consent.
5.3 Legal Incapacity: If you are legally incompetent to contract (for example, due to mental disability) you may use the Services only through a legal guardian who consents and agrees to these Terms on your behalf.
5.4 Non-Eligible Users: WeWake reserves the right to refuse access to any person who does not meet these eligibility criteria. If we discover that an ineligible user has created an account or used our Services, we may suspend or terminate the account immediately. You confirm you are not subject to any sanctions or restrictions under Indian or international laws (e.g., by the Ministry of Home Affairs).
5.5 By using the Platform, you confirm that you are not prohibited from doing so by any law – for instance, local laws in your jurisdiction that forbid astrology or related services. It is your responsibility to ensure that using our Services is lawful in your country or region. WeWake operates under the laws of India, and makes no representation that the Services are appropriate or available in any particular jurisdiction. Users who access the Platform from outside India do so at their own initiative and must comply with local laws.
6. User Accounts and Registration
6.1 Most Services on WeWake require you to create a user account. You agree to provide accurate, current, and complete information during registration and to keep it updated. The following rules apply to accounts:
6.1.1 Account Creation: To create an account, you will typically need to provide a valid email address or mobile phone number and set a password (or use an OTP verification, or third-party login like Google/Facebook if available). You must not create an account using false identity or on behalf of someone else without permission. Creating multiple accounts for the same person or sharing an account between multiple individuals is prohibited.
6.1.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials. Do not share your password or give others access to your account. We recommend enabling multi-factor authentication where available for enhanced security. You agree to notify us immediately at support@wewake.site if you suspect any unauthorized use of your account or any security breach. WeWake will not be liable for any loss or damage arising from your failure to secure your account, and you may be held responsible for losses incurred by the Company or others due to such unauthorized use.
6.1.3 Personal Information: All information you provide when creating an account (such as name, contact details, birth details for horoscope, etc.) must be truthful and yours to share. Using fake information or impersonating another person is a serious violation. WeWake handles your personal data as per our Privacy Policy, and by registering you consent to such data use.
6.1.4 Guest Access: WeWake may allow limited use of certain Services without a registered account (e.g., browsing content or making a one-time booking via “guest checkout”). If you use a Service as a guest, you may still need to provide certain information (like an email or phone number for contact and delivery of service).Guest users are still bound by these Terms. Note that information provided during a guest checkout might not be saved for future sessions, and you may need to re-enter details each time
6.1.5 Account Termination: You can delete or deactivate your account by contacting us at support@wewake.site. WeWake reserves the right to suspend or terminate accounts that are suspected to violate these Terms, are involved in fraudulent or unlawful activities, or have been inactive for a prolonged period. (See“Termination” section for more details.)
7. User Conduct and Obligations
7.1 We expect all users to use the Platform in a responsible and respectful manner. By using WeWake, you agree NOT to engage in any of the following prohibited activities:
7.1.1 Unlawful Activities: Do not use the Services for any purpose that is illegal or prohibited by these Terms. You must comply with all applicable laws and regulations while using WeWake. You agree not to solicit or encourage any unlawful behavior, not to engage in fraud, money laundering, or any activity that would give rise to civil or criminal liability.
7.1.2 Misuse of Content: Do not post, transmit, or share any content on the Platform that is defamatory, obscene, pornographic, vulgar, offensive, hateful, harassing, or otherwise objectionable. This includes content that promotes racism, bigotry, hatred, physical harm, or discrimination of any kind against any group or individual. This also includes items that are threatening to the unity, integrity, defense, security or sovereignty of India. You also must not upload viruses, malware, or any malicious code that could harm the Platform or other users’ devices.
7.1.3 Intellectual Property Violations: Do not upload or share content that infringes any third party’s rights, including copyrights, trademarks, or privacy/publicity rights. You may only post content that you have the right to use. For example, if you share birth details or horoscope data of another person, ensure you have their permission.
7.1.4 Impersonation and False Information: Do not impersonate any person or entity, or falsely state or misrepresent yourself (including pretending to be an astrologer or a WeWake representative if you are not). You must not mislead others by providing information that is intentionally false or by concealing your identity in communications.
7.1.5 Interference with Services: Do not attempt to disrupt or interfere with the functioning of the Platform. This includes not hacking, DDOS attacks, flooding, spamming, or using any automated system (bots, scripts, etc.) to access or use the Services in a manner that sends more request messages to our servers than a human can reasonably produce in the same period. Also, do not bypass any measures we use to prevent unauthorized access.
7.1.6 Unauthorised Commercial Use: Our Services are for personal, non-commercial use. You must not resell, deep-link, or commercially exploit any portion of the Platform without our prior written consent. You also agree not to collect or harvest any information about other users (including personal data) for any commercial solicitation or illegal activity such as phishing.
7.1.7 Harassment and Abuse: You will treat astrologers, instructors, WeWake staff, and other users with respect. Any form of abuse, harassment, or inappropriate behaviour during consultations (whether via chat, call, or in reviews) is strictly prohibited. We reserve the right to remove you from a session or ban your account if you are abusive or unreasonable toward any service provider or staff.
7.1.8 Circumvention: You agree not to circumvent or attempt to bypass WeWake’s Platform when availing services from our astrologers or consultants. For example, you should not solicit our practitioners to provide services outside of WeWake, nor provide your contact information to them for off-platform sessions. Engaging in off- platform transactions with our astrologers without our consent may lead to termination of your account.
7.1.9 Multiple Accounts and Referrals: You will not create multiple accounts to abuse promotions or referral programs. If we offer referral rewards or affiliate commissions, you will use them in good faith. Any attempt to game the system (such as self-referral, using fake identities, or spam referrals) is prohibited and may result in loss of rewards and account termination.
7.1.10 User Content: If in the future certain Services allow you to post or contribute content (for example, user forums, reviews, or Q&A sections), you remain responsible for the content you submit. WeWake does not pre-screen user content, but we have the right (though not the obligation) to remove or delete any content that violates these Terms or is deemed inappropriate, at our sole discretion. We may also suspend or terminate accounts associated with such content. If you believe another user is violating these rules, please report it to us at support@wewake.site.
8. Payments and Billing
8.1 Certain Services on WeWake are provided for free (e.g., reading free articles or general horoscopes), but many offerings such as one-on-one consultations, Pooja services, or courses are Paid Services. By purchasing or booking any Paid Service, you agree to the following terms regarding payments:
8.1.1 Fees: You agree to pay all charges for the Services you purchase in the amount and currency specified at the time of transaction. Prices for consultations, courses, or other services will be indicated on the Platform. WeWake reserves the right to determine pricing for all Services and to change prices from time to time. We will make reasonable efforts to inform you of any pricing changes in advance (for instance, changes to subscription fees or new service fees). If you continue to use the Service after the price change takes effect, you agree to pay the updated price.
8.1.1 Fees: You agree to pay all charges for the Services you purchase in the amount and currency specified at the time of transaction. Prices for consultations, courses, or other services will be indicated on the Platform. WeWake reserves the right to determine pricing for all Services and to change prices from time to time. We will make reasonable efforts to inform you of any pricing changes in advance (for instance, changes to subscription fees or new service fees). If you continue to use the Service after the price change takes effect, you agree to pay the updated price.
8.1.2 Currency: Unless otherwise stated, all fees are listed in Indian Rupees (INR). If you are making payment from outside India or in a different currency, your payment provider (bank or card issuer) might automatically convert the amount to INR and charge applicable exchange rates or fees, which are your responsibility. WeWake is not responsible for any currency conversion differences or international transaction fees.
8.1.3 Payment Methods: WeWake supports various payment methods for your convenience, such as credit/debit cards, net banking, UPI, digital wallets, or other payment gateways. When you provide payment information, you represent that you are authorized to use the payment method. You authorize us (and our designated payment processors) to charge the full amount to the payment method you designate for the transaction.
8.1.4 Third-Party Payment Processing: Payments are processed through secure third-party payment gateways. We do not store your full financial details (like full credit card numbers) on our servers. While we strive to use reputable providers and secure technology, WeWake is not liable for any issues arising from the payment process. This includes: payment failures or delays, unauthorized transactions (unless due to our negligence), bank rejections, technical glitches, or theft of financial data during or after the transaction that are outside our control.
8.1.5 Payment Issues: In certain cases, a payment might fail or be delayed (for example, due to insufficient funds, network issues, or bank limits). It is your responsibility to ensure your payment details are correct and you have sufficient funds. If a payment does not go through, WeWake has no obligation to provide the Service until payment is successfully received. If you believe your payment was wrongly processed or charged, please contact us immediately at support@wewake.site and we will review the issue. In the event of a chargeback, you agree to reimburse us for any associated fees or costs incurred.
8.1.6 Taxes: Prices listed on the Platform generally include applicable taxes (like GST) unless stated otherwise. fees are inclusive of applicable taxes as required under Indian law. You are responsible for any other taxes, duties, or charges that may be applicable in your jurisdiction.
8.1.7 Subscription Billing: If you enroll in a subscription or membership plan (when such plans are offered), you agree to the subscription terms presented to you at sign-up. Typically, subscriptions will be billed on a recurring cycle (e.g., monthly or annually) and will auto-renew at the end of each cycle unless you cancel. By providing your payment details for a subscription, you authorize WeWake to charg the recurring subscription fee to your payment method on each renewal until you cancel. We will inform you of important subscription terms, such as renewal dates and how to cancel, when you subscribe. You can cancel a subscription at any time by following the instructions in your account settings or contacting Customer Support; cancellation will stop future billing but will not retroactively refund the current period except where required by law or stated in a specific offer.
9. Cancellation and Refund Policy
9.1 WeWake aims to be fair and transparent in our cancellation and refund policies while protecting the integrity of our services. Please note the following terms regarding appointment cancellations, rescheduling, and refunds for paid Services:
9.1.1 Consultation Bookings: When you book a paid session (astrology consultation, coaching call, etc.), that time is reserved exclusively for you with the chosen Practitioner. Cancellations by You: If you need to cancel or reschedule, you must notify us as soon as possible. We generally require at least 48 hours’ notice before the scheduled session start time for any rescheduling or cancellation requests. If you cancel late (less than 48 hours prior) or fail to show up for a session, no refund will be issued. In our discretion and only in exceptional circumstances (such as a documented medical emergency), we may choose to offer a partial refund or a one-time rescheduling despite late notice – but this is not guaranteed.
9.1.2 Rescheduling: If you request to reschedule a session more than 48 hours in advance of the appointment, we will do our best to accommodate a new time slot for you. Rescheduling is subject to availability of the astrologer or service provider. A rescheduling request with sufficient notice will not incur additional charges for the first change; however, repeated reschedule requests may be treated as a cancellation.
9.1.3 Refund Eligibility: As a general rule, all sales are final. Refunds are only available if requested and no service has been initiated or delivered. WeWake does not offer refunds for services that have been delivered or substantially delivered. For example, if an astrology consultation has taken place (or a report has been prepared and sent), the service is considered rendered and non-refundable. We also do not issue refunds simply because a user is unhappy with the advice or outcome of a session. Astrology and spiritual services are subjective in nature – results and satisfaction can vary by individual, and therefore we cannot guarantee outcomes or offer refunds on the basis of the content of the guidance (see “Critical Disclaimers & Limitation of Liability” below). All refund decisions will be made in accordance with the policy stated herein and shall be final. Exceptions may apply for non-delivery due to our fault, at our discretion.
9.1.4 Exceptions: In cases where the service was not delivered at all or was severely deficient due to a clear fault on our side, WeWake may provide a refund or credit. For instance, if you paid for a service that we could not fulfil, or a technical failure on our platform prevented your session from occurring and we cannot reschedule, we will refund the applicable fees. Any approved refunds will be processed via the original payment method or as a credit to your WeWake account/wallet/original payment method, at our discretion.
9.1.5 Quality Assurance: If you have a complaint about the quality of a service (e.g., you believe a Practitioner was unprofessional or the session was otherwise problematic), please contact Customer Support at support@wewake.site within 24 hours of the session. We take user feedback seriously and will investigate the issue. As part of our quality assurance, WeWake may review communication logs or recordings (with your consent as provided, see “Privacy & Data Use”). Recordings will not be shared with Users, but an AI-generated summary or report may be provided (if applicable) as part of the resolution process, per Section 11.1.7. If we find that the Practitioner seriously deviated from our standards, we may provide a remedy to you (such as a follow-up session with a different Practitioner or a partial or a full refund) at our discretion. However, dissatisfaction with the content of advice (as opposed to a service error) does not generally qualify for a refund.
9.1.6 Pooja Services and Product Purchases: If you order a Pooja service through WeWake (for example, religious items or prasad), any cancellation or refund rights
might be specified at the time of purchase. Many Pooja services involve coordination and materials, so cancellations might not be possible once the purchase has been
made. However, if you need to cancel or reschedule a Pooja, please let us know at a minimum of 72 hours in advance so we may try to accommodate your request. If a
delivered product is defective or not as described, please notify us within 7 days and we will work with you to arrange a replacement or refund in line with consumer
protection laws and our specific product return policy.
9.1.7 Chargebacks and Disputes: You agree to contact us and attempt to resolve any issue with a service before initiating a chargeback or payment dispute with your bank or card provider. If you dispute a charge without contacting us, and the charge is later found to be valid, you will be responsible for any associated bank fees and amounts reversed from us. We also reserve the right to terminate your account for improper or fraudulent chargebacks.
9.2 WeWake’s decision on refunds and cancellations shall be final. Any deviation from our stated policy in an individual case (for example, granting a refund as a courtesy) will not constitute a waiver of these terms in the future. Please refer to any specific cancellation/refund terms if displayed at the point of purchase for particular services, as those will apply in addition to the general terms above.
10. Intellectual Property Rights
10.1 All content and materials available on the WeWake Platform, including but not limited to text, graphics, logos, images, audio clips, videos, software, and compilations thereof (collectively, the “Site Content”), are the property of WeWake or its content suppliers and are protected by intellectual property laws (copyright, trademark, etc.). The overall compilation of our Site Content, and the software and technology underpinning the Services, are proprietary to WeWake. You acknowledge that all AI-generated reports (if applicable) are owned by WeWake.
10.1.1 License to You: WeWake grants you a limited, non-exclusive, non- transferable, revocable license to access and use the Platform and the Site Content for your personal, non-commercial use only, as needed to utilize the Services in accordance with these Terms. You may not duplicate, reproduce, redistribute, sell, create derivative works from, or otherwise exploit any portion of the Site Content for any commercial or public purpose without our express prior written permission.
10.1.2 Trademarks: “WeWake,” our logo, and any other trademarks, service marks, or trade names displayed on the Platform are the property of WeWake or third parties (where noted). You are not permitted to use any trademarks appearing on the Platform without the respective owner’s prior written consent.
10.1.3 User-Provided Materials: In the course of using the Services, you might provide information or materials to us – for example, personal data for horoscope analysis, questions for Q&A sections, reviews or testimonials, etc. You retain ownership of any original content you submit (such as the text of a review you write). However, by submitting any content or materials to WeWake (excluding personal data which is handled under the Privacy Policy), you grant us a worldwide, royalty- free, perpetual license to use, reproduce, modify, display, and distribute that content for the purpose of providing and promoting our Services. This license is necessary for us to, for example, display your success story or comment on our website, or to use feedback to improve our offerings. We will not sell or license your content to third parties for their independent use without your permission.
10.1.4 No Unauthorised Use: You agree not to reverse-engineer, decompile, or disassemble any aspect of the Platform, nor attempt to extract source code or algorithms. You also shall not use any automated systems (such as robots or scraping tools) to harvest information from the Platform. If you want to make use of our data or content beyond the allowed personal use, please contact us for permission or applicable API/license opportunities.
10.1.5 Prohibition on AI Training: You shall not use any content, consultations, or reports from the Platform to train or develop artificial intelligence, machine learning systems, or similar technologies without our express written consent. Any such use is unauthorized and may result in immediate termination and legal action.
10.1.6 You acknowledge that all AI-generated reports, recommendations, or content (if applicable) are the sole property of WeWake. 10.2 Any infringement of our intellectual property or misuse of the Platform content may result in termination of the granted license and may also violate applicable laws, which could lead to legal action.
11. Privacy and Data Use
11.1 Your privacy is important to us. Our Privacy Policy, available on our website, explains how we collect, use, store, and protect your personal information. By using the Services, you consent to the collection and use of your information as outlined in the Privacy Policy. We encourage you to read the Privacy Policy carefully. We comply with the Digital Personal Data Protection Act, 2023, and other applicable data laws. As a 'Data Fiduciary,' we process your data with consent and for legitimate purposes. For data-related grievances, contact our Data Grievance Officer at grievance@wewake.site. We will respond to data rights requests within timelines prescribed by law. Key points regarding data use include:
11.1.1 Personal Data: WeWake will collect certain data from you (such as contact details, birth information for astrology, etc.) to deliver the Services. This data will be
used and protected in accordance with our Privacy Policy. We implement industry-standard security measures to safeguard your information, but we cannot guarantee
absolute security. By using WeWake, you acknowledge and accept the inherent risks of data transmission over the internet.
11.1.2 Communication: By providing us with your contact information (email, phone number), you agree that WeWake may send you transactional communications (e.g., booking confirmations, reminders, account alerts). We may also send you promotional messages (such as newsletters or special offers), from which you can opt-out at any time by using the unsubscribe link or contacting support. However, even if you opt out of marketing emails, we may still send you important service- related communications (e.g., changes to terms, security notifications).
11.1.3 Cookies and Tracking: The Platform may use cookies and similar technologies to enhance user experience and analyse usage. Our Privacy Policy details these practices. By using the site or app, you agree to our use of cookies as described in the Privacy Policy (unless you adjust your browser settings to refuse cookies, which may affect functionality).
11.1.4 Third-Party Services: We may integrate third-party services to facilitate our offerings (for example, a video conferencing tool for live sessions, a payment processor, or an email service for newsletters). When you use these integrated services within WeWake, some of your data may be shared with those third parties as needed (e.g., your name and email might be shared with a webinar hosting platform to send you an invite). We strive to work with reputable providers and we share only what is necessary. However, those third-party services are governed by their own privacy policies and terms. WeWake is not responsible for how third parties manage your data, so please review their policies as well when you use such services through our Platform.
11.1.5 Data Retention: WeWake will retain your personal data for as long as reasonably necessary to fulfil the purposes for which it was collected, or as required by law. If you delete your account or request data deletion, WeWake will delete or anonymize your personal information in accordance with applicable law. However, please note that: WeWake reserves the right to retain certain data even after account deletion, if we have a legitimate reason to do so. Such retained data will not be used for marketing or any new purposes unrelated to the original service. It will be stored securely and accessed only when necessary (e.g., to comply with a legal obligation, resolve a dispute, or respond to a law enforcement request). We retain this information to protect both you and us. For instance, in the unlikely event of a complaint or legal claim (such as a user claiming they were harmed by advice given), we need the historical record to understand what was communicated. This policy is also intended to meet any compliance requirements from audits or regulatory bodies that may ask to review our service records. In addition, WeWake may use anonymized and aggregated data (with all personal identifiers removed) for internal research, analytics, and training purposes, including improving our services and developing AI-enabled features. Such anonymized data will not be used to identify you personally. Anonymized data may be retained indefinitely for research/training. Data may be processed by reputed third-party AI service providers under confidentiality agreements.

11.1.7 All consultations and sessions will be recorded as a rule, with your explicit consent obtained before the session begins (e.g., via a click-box or verbal agreement). Recordings are used solely for quality assurance, dispute resolution, legal compliance, audits, or to generate AI-enabled summaries/reports, as per our Privacy Policy. Recordings are not provided to Users under any circumstances to protect privacy, confidentiality, and intellectual property of WeWake and Practitioners. If you consent to recording, you may receive an AI-generated summary or report (if available) via the Platform, which provides key insights from the session. Without consent, recordings will not occur, and certain features (e.g., summaries) may be unavailable, but the session may proceed. You may not record sessions independently without written permission from WeWake, as this violates our intellectual property rights (Section 10) and confidentiality obligations.
11.1.8 Requests for access to session recordings will not be fulfilled, as recordings are retained solely for internal purposes (e.g., quality assurance, legal compliance) and contain sensitive data protected under the DPDPA, 2023. Instead, Users may access AI-generated summaries or reports (if consented) through their account dashboard, which are designed to provide session insights while safeguarding privacy and proprietary content. 11.2 We comply with the Digital Personal Data Protection Act, 2023, and all applicable data protection laws. As a “Data Fiduciary,” we collect and process personal data only with consent or for legitimate purposes. For grievances, you may contact our Data Grievance Officer at grievance@wewake.site. Data will be retained as legally required, including recordings and reports, even after account deletion, for compliance, audit, and dispute resolution purposes.
11.3 By using the Services, you acknowledge that you have read our Privacy Policy and understood how WeWake processes your data. If there is any conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy will prevail.
12. Disclaimers & Limitation of Liability
12.1 All astrology, spiritual, and related services provided on the Platform are offered for entertainment, informational and personal growth purposes, based on traditional practices. These services may not be scientifically validated or guaranteed, and they are not a substitute for professional medical, financial, legal, or psychological advice.
12.2 To the fullest extent permitted by law, WeWake provides the Services on an “as-is” basis and disclaims all warranties, express or implied, including accuracy, reliability, or any particular outcome. WeWake shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Platform.
12.3 Monetary Cap: In no event shall WeWake’s total liability exceed the greater of INR 5,000 or the total fees you paid to WeWake in the three (3) months immediately preceding the claim.
12.4 You agree that reliance on any information or advice provided through the Services is solely at your discretion and risk. WeWake encourages you to treat the Services as supportive insights among many, and to make your own independent decisions.
12.5 Practitioners are independent contractors and not employees, partners, or agents of WeWake. They are solely responsible for the services they provide. WeWake does not supervise or guarantee their advice and assumes no liability for their actions or omissions.
12.6 You acknowledge that you are solely responsible for your choices and actions. To the fullest extent permitted by law, WeWake and its Practitioners disclaim liability for any harm, including self-harm or third-party harm, allegedly arising from use of the Services.
13. Indemnification
13.1 You agree to indemnify, defend, and hold harmless WeWake (Spiritual Sutra Private Limited) and its officers, directors, employees, consultants, affiliates, agents, and representatives from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and legal costs) arising out of or related to:
13.1.1 Your use (or misuse) of the Platform or Services, or anything you do in connection with a Service;
13.1.2 Your violation of these Terms or of any applicable law or regulation;
13.1.3 Any content or information you provide to us (e.g., if you submit information that violates someone’s rights or is misleading, and we face a claim because of it);
13.1.4 Your infringement of any intellectual property or privacy rights of any person or entity;
13.1.5 Any dispute you have with a third-party (including any Practitioner, consultant, or other user) arising from your use of the Services; or
13.1.6 Your breach of confidentiality or misuse of consultation reports.
13.2 WeWake reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with our defense of that claim, and you may not settle any claim without our prior written consent. Your indemnification obligation will survive any termination of your relationship with WeWake or cessation of use of our Services.
13.3 This includes claims arising from your breach of confidentiality or misuse of consultation reports.
14. Termination of Services
14.1 Termination by User: You may decide to stop using WeWake’s Services at any time. You may delete your account at any time by following the instructions on the Platform or contacting us at support@wewake.site. Upon deletion, you will lose access to any member-only features, and your profile information may no longer be visible. However, as noted in our Privacy section, certain data (like invoices, communications, session records) may be retained by us as required or permitted by law. Deleting your account or ceasing use of the Services does not automatically entitle you to a refund of any fees already paid, except as provided in our Refund Policy. If you are enrolled in a subscription, you must cancel the subscription to stop recurring charges.
14.2 Termination or Suspension by WeWake: WeWake may, in its sole discretion, suspend or terminate your access to the Platform (or any portion of the Services) at any time, with or without notice, if we have reason to believe:
14.2.1 You have violated these Terms or any applicable law;
14.2.2 You have engaged in conduct that is fraudulent, abusive, or harmful to other users, service providers, or the interests of WeWake;
14.2.3 You have used the Services in a manner that could cause us legal liability or disrupt others’ use of the Services; or
14.2.4 We are required to do so by law enforcement or other government authorities (for example, if we discover that you are on a sanctions list or under legal investigation that involves our Services).
14.3 In some cases, we may suspend your account temporarily while investigating suspected misconduct. We may also remove or ban you from specific activities (e.g., participating in a forum or posting reviews) without terminating your whole account, as appropriate. WeWake shall not be liable to you or any third party for any termination of your account or access to our Services under these Terms.
14.4 Effect of Termination: Upon any termination of your account, whether by you or by us, your right to use the Services will immediately cease. You must cease all use of the Platform and any content obtained through it. Any licenses granted to you (for example, to use the mobile app) will end. WeWake may, but is not obligated to, delete or anonymize your account information and content after termination, except for data we are permitted to retain as explained in the Privacy section.
14.5 Even after termination, certain provisions of these Terms will survive and remain in effect, including (but not limited to) provisions related to Intellectual Property, Critical Disclaimers & Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law. Any outstanding payment obligations you have accrued before termination will also remain due (for example, if an instalment is pending).
14.6 If you wish to rejoin WeWake after termination, you must contact us and obtain permission. We reserve the right to decline re-registration or reactivation at our discretion.
15. Changes to Terms and Services
15.1 Updates to Terms: WeWake may modify or update these Terms from time to time to reflect changes in our Services, legal obligations, or for other operational reasons. If we make material changes, we will notify users by posting the updated Terms on our website (and updating the “Last Updated” date above). Material changes will be notified at least 15 days in advance via email or other electronic communication. In some cases, for significant changes, we may also notify you via email or via an in-app notification. It is your responsibility to review these Terms periodically. Continued use of the Services after updated Terms have been posted constitutes your acceptance of those changes. If you do not agree to a change in the Terms, you should stop using the Services and, if needed, delete your account.
15.2 We may ask for your explicit consent to a revised version of the Terms if required by law, but in most cases, publishing the changes and your continued use will suffice as acceptance.
15.3 Changes to Services: WeWake is constantly evolving. We may add, remove, or change features and services, or we may stop providing a particular Service or part of the Platform altogether. We reserve the right to do so at any time, with or without notice. For example: we might introduce a new consultation format, discontinue a less-used feature, or update the software that may change the user interface. We may also impose limits on certain features or restrict your access to parts of or all of the Services without notice or liability.
15.4 We will not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the Services. If a change affects the way you use a paid Service (for instance, a change in subscription features or price), we will aim to inform you in advance, and you may have the right to cancel the service before the next billing if you do not agree to the new terms.

However, the final decision on any changes remains with WeWake.
16. Governing Law and Jurisdiction
16.1 These Terms and any disputes arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The applicability of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. WeWake is based in India, and we operate under Indian legal and
regulatory standards.
16.2 If you are a consumer located outside India, you may be entitled to certain protections under the mandatory laws of your country of residence; these Terms are not intended to limit those protections to the extent they apply. However, by choosing to use WeWake’s Services, you acknowledge that Indian law will govern any procedural and substantive issues to the maximum extent permissible.
16.3 Jurisdiction: You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the courts of competent jurisdiction in Mumbai, Maharashtra, India, unless otherwise required by a mandatory law of your jurisdiction (in which case, you agree that the dispute may be adjudicated in your local courts but still applying Indian substantive law). You consent to the personal jurisdiction of such courts and waive any objection on grounds of venue or inconvenient forum.
16.4 Dispute Resolution: Any disputes shall first be resolved through good-faith negotiation within 30 days. If unresolved, they shall be referred to binding arbitration in Mumbai under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed in accordance with the Act (e.g., by the Mumbai Centre for International Arbitration). The award shall be final and binding. The seat of the arbitration shall be Mumbai, Maharashtra. The language of the arbitration shall be English. Litigation, if any, shall be limited to granting interim relief or enforcement of the arbitral award in Mumbai courts. 16.5 Please note that any legal claim against WeWake must be brought by the actual individual (or entity) who used the Service or is directly affected. WeWake may require proof of your identity before addressing legal claims or disputes, to ensure that only rightful parties are involved.
17. Miscellaneous Provisions
17.1 Entire Agreement: These Terms (along with any additional policies or guidelines referenced, such as our Privacy Policy and any specific service terms presented at purchase) constitute the entire agreement between you and WeWake regarding the use of our Services. They supersede any prior agreements, communications, or understandings (whether oral or written) relating to the subject matter. Any additional or different terms you seek to impose (for example, in an email or chat) have no effect unless agreed to in a written agreement signed by an authorized representative of WeWake.
17.2 Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remainder of the Terms shall continue in full force and effect. The invalid provision will be deemed modified so as to be enforceable and reflect as closely as possible the original intent behind it, or if modification is not possible, deemed severed from these Terms.
17.3 No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by WeWake. Similarly, if we do choose to waive a default by you, that does not mean we waive any later defaults you may commit.
17.4 Assignment: You may not assign or transfer your rights or obligations under these Terms to any third party without our prior written consent. WeWake may assign or transfer these Terms (in whole or in part) as part of a merger, acquisition, reorganization, or sale, or by operation of law or otherwise. These Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns and will not affect the user’s rights.
17.5 Relationship: Nothing in these Terms shall be deemed to create an agency, partnership, joint venture, or employer-employee relationship between you and WeWake. You and WeWake are independent contracting parties. Practitioners are typically independent contractors and not employees of WeWake, unless expressly stated. WeWake is a facilitator of services and not the direct provider of professional advice, as noted.
17.6 Force Majeure: WeWake shall not be liable for any delay or failure in performance of any part of the Service caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil disturbances, strikes or labour disputes, pandemic or widespread illness, electrical or telecommunication outages, internet or utility failures, cyber-attacks or data breaches beyond our control, or any government restrictions. During such events, our obligations will be suspended to the extent of the impairment, and we will make reasonable efforts to resume service as soon as practicable. Force Majeure includes natural disasters, pandemics, government restrictions, cyber-attacks, or data breaches beyond our reasonable control.
